Terms and Conditions
1. Scope and seller
These Terms and Conditions apply to all orders placed through the online shop madluxx.com. The seller and your contracting party is Madluxx GmbH, Kaffeestrasse 8d, 8180 Bülach, Switzerland, email: info@madluxx.com, registered in the commercial register of the Canton of Zurich under UID CHE-413.382.173 (“Madluxx”, “we” or “us”).
Our offer is aimed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession.
2. Conclusion of the contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order. You may add products to your cart without obligation and correct your details at any time before submitting your order, using the correction options shown during checkout. By clicking the order button, you make a binding offer to purchase the items in your cart.
Immediately after submitting your order, you will receive an order confirmation by email. With this order confirmation we accept your offer, and the purchase contract is concluded.
3. Contract languages and storage of the contract text
The contract may be concluded in English, German, French or Italian. The language in which you place your order applies.
We store the contract text. We send you your order details, these Terms and Conditions and the withdrawal information by email together with the order confirmation. The current Terms and Conditions are available at any time on madluxx.com.
4. Prices and shipping costs
All prices are final prices and include statutory VAT. For deliveries to Germany, Austria and France, no customs duties or import charges are payable by you; we cover them.
- Germany, Austria, France: shipping €10, free shipping on orders of €250 or more.
- Switzerland: shipping CHF 4.90, free shipping on orders of CHF 250 or more.
5. Delivery
We deliver to addresses in Germany, Austria, France and Switzerland. Delivery takes 2–4 working days to Germany, Austria and France and 1–3 working days within Switzerland, in each case from conclusion of the contract. Any different delivery times are stated on the respective product page.
Please check your delivery address before completing your order. If a parcel has to be re-sent because you provided an incorrect address, we will charge the shipping costs for the new shipment.
6. Payment
The payment methods shown during checkout are available, currently in particular credit card (Visa, Mastercard, American Express, UnionPay), PayPal, Apple Pay, Google Pay, Shop Pay and Klarna. If you pay via PayPal, Klarna or Shop Pay, you will be redirected to the respective provider, whose terms shown to you there apply in addition. When purchasing on invoice via Klarna, you pay Klarna within the period specified by Klarna.
7. Retention of title
The goods remain our property until paid in full.
8. Transport damage
If goods are delivered with obvious transport damage, please report this to the delivery service as soon as possible and contact us. If you do not do so, this has no effect whatsoever on your statutory rights. It does, however, help us to assert our own claims against the carrier.
9. Statutory warranty and guarantee
Your statutory warranty rights apply. The statutory warranty period is two years from receipt of the goods.
In addition, we provide a voluntary 24-month guarantee in accordance with our guarantee terms (madluxx.com/pages/garantiebedingungen). The guarantee applies in addition to your statutory rights and does not restrict them.

10. Right of withdrawal and returns
Consumers resident in the European Union have a statutory right of withdrawal of 14 days. For customers in Switzerland, we voluntarily grant a right of withdrawal on the same terms. Details, the return addresses, the model withdrawal form and the online withdrawal function can be found in our withdrawal information.
Please examine the goods as you would in a store. If returned sunglasses show signs of wear or damage beyond what is necessary for such an examination, you must compensate us for the loss in value; this may be up to the full purchase price. This applies equally to customers in the EU and in Switzerland.
We accept no liability for the loss of or damage to parcels sent to us in error that do not contain Madluxx products.
11. Undeliverable parcels
If a parcel cannot be delivered despite several attempts and is returned to us, we will contact you. At your request, we will send the goods again; you bear the costs of the new shipment if you are responsible for the failed delivery. Otherwise, we will refund all payments received.
12. Discount codes
- Discount codes can only be redeemed in the online shop madluxx.com, are valid once per customer and order, and cannot be combined with other discount codes.
- The period of validity and any minimum order value are stated for each discount code. Discount codes cannot be extended, paid out in cash or transferred.
- For orders with several items, the discount is allocated proportionately across the items. If you return individual items, we refund the amount actually paid for those items. There is no entitlement to a new discount code.
13. Gift cards
Where we offer gift cards, the following applies: Madluxx gift cards are valid for three years from the date of purchase and can be redeemed for all products in the online shop madluxx.com. They cannot be exchanged for cash. If an item paid for with a gift card is returned, the corresponding amount will be credited back to the gift card.
14. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under any guarantee we have given, and under the rules on product liability.
In the event of a slightly negligent breach of an essential contractual obligation – that is, an obligation whose fulfilment is essential for the proper performance of the contract and on whose fulfilment you may regularly rely – our liability is limited to the damage that was foreseeable and typical for the contract at the time the contract was concluded. Otherwise, liability for slight negligence is excluded. These provisions also apply to our legal representatives and vicarious agents.
Mandatory statutory provisions, in particular consumer protection laws in your country of residence, remain unaffected.
15. Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body. If you have any questions or complaints, please contact us directly at info@madluxx.com.
16. Governing law
These Terms and Conditions are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident in a Member State of the European Union, you retain the protection afforded to you by the mandatory consumer protection provisions of that state.
17. Final provision
Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected.
