General Terms and Conditions (GTC) – Madluxx

  1. Scope

The following GTC apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not related to their commercial or self-employed professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

  1. Contractual Partner, Conclusion of Contract

The purchase contract is concluded with Madluxx. The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You can first place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained for this purpose in the ordering process. By clicking the order button, you submit a binding order for the items in the shopping cart. Confirmation of receipt of your order is sent by email immediately after the order is submitted. The time at which the contract is concluded with us depends on the payment method you have selected:

Klarna Invoice
We accept your order by sending a declaration of acceptance in a separate email or by delivering the goods within two days.

Credit Card
When you place your order, you also submit your credit card details to us. After confirming you as the legitimate cardholder, we request your credit card company to initiate the payment transaction, thereby accepting your offer.

PayPal, PayPal Express
During the ordering process, you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After submitting your order in the shop, we request PayPal to initiate the payment transaction, thereby accepting your offer.

Sofort by Klarna
After placing your order, you will be redirected to the website of the online provider Sofort GmbH, where you confirm the payment instruction. The contract is thus concluded with us.

  1. Contract Language, Storage of Contract Text

The language available for the conclusion of the contract is German. We store the contract text and send you the order data and our GTC by email. You can view the contract text in our customer login.

  1. Delivery Conditions / Shipping

Deliveries are possible to delivery addresses within Switzerland and Liechtenstein. Shipping within Switzerland and Liechtenstein is free of charge. Orders are delivered exclusively via shipping.

If a shipment has to be resent due to an incorrectly entered address by the buyer, we reserve the right to subsequently charge a flat shipping fee. This fee is CHF 7.00. It is the buyer’s responsibility to verify all information before completing the order process.

  1. Payment

The following payment methods are generally available in our shop:

Credit Card
When you place your order, you also submit your credit card details to us. After confirming you as the legitimate cardholder, we immediately request your credit card company to initiate the payment transaction. The payment transaction is then automatically executed by the credit card company and your card is charged.

PayPal, PayPal Express
During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or first register, authenticate with your access data, and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal immediately thereafter. Further instructions are provided during the ordering process.

Sofort by Klarna
After placing your order, you will be redirected to the website of the online provider Sofort GmbH. To pay the invoice amount via Sofort, you must have an online banking account activated for participation in Sofort with PIN/TAN procedure, identify yourself accordingly, and confirm the payment instruction to us. Further instructions are provided during the ordering process. The payment transaction is carried out by Sofort immediately thereafter and your account is debited.

Purchase on Invoice via Klarna
In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer invoice purchase as a payment option. Please note that Klarna invoice is only available to consumers and that the payment must be made to Klarna. When purchasing on invoice via Klarna, you always receive the goods first and always have a payment period of 14 days.   1. Retention of Title

The goods remain our property until full payment has been made.

  1. Transport Damages

If goods are delivered with obvious transport damage, please report such defects immediately to the deliverer and contact us without delay. Failure to lodge a complaint or contact us has no consequences for your statutory claims and their enforcement, particularly your warranty rights. However, it helps us assert our own claims against the carrier or transport insurance.

  1. Warranty and Guarantees

The statutory liability for defects applies. For used goods: if the defect arises after one year from delivery of the goods, claims for defects are excluded. Defects occurring within one year from delivery of the goods can be asserted within the statutory limitation period of two years.

  1. Statutory Right of Withdrawal

Information on the statutory right of withdrawal can be found here. The statutory right of withdrawal is mandatory for both parties. It takes precedence and applies for 14 working days from the delivery date.

9.1 Incorrectly Sent Returns

We are not liable for the loss, deterioration, depreciation, or damage of returns that are incorrectly sent to us and do not concern our products, regardless of the legal basis.

  1. Undeliverable Shipments

If your order cannot be delivered after several attempts for reasons not attributable to us, it will be returned to us. In this case, we assume that you wish to withdraw from the contract, which is then automatically converted into an obligation to return goods. As a result, we will refund all payments received from you, excluding shipping costs, without delay and at the latest 14 days after the withdrawal (excluding additional costs resulting from your selection of a different delivery method than the standard delivery offered by us).

  1. Discounts, Discount Codes & Madluxx Gift Cards

11.1 Discounts & Discount Code Usage

Each discount code can be used only once per purchase and per customer. Only one discount code can be used per order. Combining multiple discount codes is not possible.

If a discount code is applied to an already reduced offer price (larger packaging unit / bundle), the discount will be deducted from the unit price. Discount codes cannot be paid out in cash or otherwise settled or refunded. Discount codes issued to a customer are excluded from resale; transfer is not permitted. The discount codes are valid exclusively for the Madluxx online shop (https://www.madluxx.com).

Validity:

Discount codes are valid for a limited period. They lose their validity after the date stated on the code. Extensions are excluded.

Minimum Order Value:

A minimum order value is always stated in the detail information of the respective discount code. If the minimum value is subsequently undercut due to a return, Madluxx reserves the right to charge the difference between the order with and without the discount code.

Returns:

If you make use of your right of withdrawal or return goods for other reasons, only the reduced purchase price will be refunded. There is no entitlement to a refund or reissue of the discount code.

Multiple Items in One Order:

If an order using a discount code consists of several items (cart discount), Madluxx reserves the right to apply the reduced amount to one or several items proportionally.

Non-fulfillment of an Order or Delivery:

If the order or individual items related to the discount code are not fulfilled, there is no claim for reimbursement of the code value or for a new discount code.

Third-party Discount Codes:

Redemption of discount codes, vouchers or bonus systems from third-party providers such as Miles&More, PayPal, PayBack, Otto.de or Amazon is not valid. We are not responsible for the timeliness or accuracy of offers or discount codes on third-party websites.

11.2 Madluxx Gift Cards

Usage:

Madluxx Gift Cards can be purchased through the online shop. The value is determined before the purchase is completed. Gift Cards are valid exclusively for the Madluxx online shop (https://www.madluxx.com).

Validity:

All Madluxx Gift Cards are valid for three years from the date of purchase. They can be redeemed for any product in the shop. No minimum order value applies.

Returns:

The right of return remains unaffected. The specified terms and conditions apply. If a product is returned or refunded, the amount due will be credited back to the gift card. A payout to any other payment method is excluded.

  1. Liability

The above limitations and shortened limitation periods do not apply to claims for damages caused by us, our legal representatives, or vicarious agents:

  • in case of injury to life, body or health,

  • in case of intentional or grossly negligent breach of duty,

  • in case of guarantee commitments, if agreed, or

  • insofar as the scope of the Product Liability Act applies.

In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper performance of the contract and on whose observance the contractual partner may regularly rely (cardinal obligations), due to slight negligence by us, our legal representatives or vicarious agents, liability is limited to the foreseeable damage typical for the contract. Any further claims for damages are excluded.

  1. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which can be found at https://ec.europa.eu/consumers/odr. We are not obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
